How Congressional Reps Should Respond to Media on Gun Control

The media is in a gun control frenzy.  They love to bait gun control opponents with loaded questions.  Here is my proposed response that works with just about any question from the media:

"Let me get this straight.  Are you saying that Congress should pass laws infringing on the right of the people to keep and bear arms?"  Then, to paraphrase Stephen Colbert, "Have you read the Constitution?"

Even it more gun control were a good idea, it is NOT the province of the federal government under our federal system.  The first questions any congress person should ask before voting for ANY legislation is whether it is properly a matter for the federal government.  If the answer is no, vote no.

Under the Second amendment, it is the exclusive province of the states to regulate firearms.  "...Congress shall make no law...."  Not some laws.  Not limited laws.  Not reasonable laws.  No law.

No law means none, zero, zip.

I wish the Supreme Court could read plain English.

If gun regulation is such a great idea, persuade the state legislatures.

Focus on "Violent Crime," not "Gun Violence"

The left's new weapon against guns is ... words. Now the left is all concerned about curbing "gun violence." Apparently Piers Morgan and crew prefer you to be stabbed or bludgeoned to death rather than shot by a firearm. The problem is "violent crime" not violence only by gun.

When they focus on "gun violence" rather than "violent crime" they ignore the problem. Their message is that they would be happy if violent criminals to change their methods. They want them to choose weapons other than guns. The leftists apparently don't care about knife violence, death by bludgeon, death by strangulation, death by poison and on and on.

 The left does not want you to use a gun to be able to defend against a violent attack. Bulk up, ladies. According to the left, you should not be such wimps. Defend yourselves with your bare hands. So what if your attacker outweighs you by a hundred pounds or so?

 Back to the point. Every time the anti-gun crowds talks about "gun violence," they should be corrected. The problem is violent crime, whether by gun, knife, baseball bat or any other weapon. Focusing only on gun violence is completely dishonest.

Where is the "blood in the streets" the liberals like Toby Hoover predicted? (I originally wrote "goofy liberals," but recognizing that as a redundancy, I omitted the word goofy.)

I suspect that Toby Hoover is actually disappointed with the safety of shall-issue concealed carry in Ohio. No one likes to be wrong.

The truth is that gun restriction, like all regulation, punishes the innocent law abiding people only. Law breakers are ... well ... law breakers.

Moron of the Day: Charles (Chuck) Shumer (D NY)

Gun banner Senator Charles (Chuck) Shumer has introduced the misnamed (as is typical) "The Fix Gun Checks Act of 2011" that would bar anyone arrested for a drug crime from possessing a firearm for 5 years. Reference the Daily Caller.

Yes, you read that right. Arrested. Not convicted.

We don't need no stinkin' trials to take away gun rights. Let the police be the judge and jury. Just make an arrest.

Someone hitting on your wife, just make an arrest for drugs, it doesn't have to stick, and no gun rights. Someone looks at you sideways, arrest on a false drug charge. someone smart-mouths the officer, arrest on a false drug charge. You want justice, I'll give you justice, man.

In what strange universe does Mr. Shumer think that would pass constitutional muster. Hey, it really doesn't have to as a teomprary measure. It would take years to get it to the supreme court. We don need no stinkin' rule of law in Mr. Shumer's America.

California Handgun Ammunition Law

A California court has found that the definition of handgun ammunition in the penal statutes is void for vagueness.

Moron of the Day: Pete King (R-NY)

Get this. Republican Representative Pete King want to introduce legislation banning guns within 1000 of any member of congress or other "high profile official."

Dumb. Roving gun-free zones. That would make me a criminal if a congress-critter drove past my house. Forget shooting ranges. A congressman goes near, across the street even, the range has to shut down. And what about congress-folk who actually carry guns (yes, there are some)?

A well deserved "Moron of the Day" award to Rep. Pete King.

Rep. Gabrielle Giffords's Medical Condition Stable

This morning's news reports no change in Rep. Giffords's medical condition, which is good news. It means there is no swelling, which was a risk.

Our prayers are with her.

One can only speculate how the tragedy would have been different if someone else in the crowd had been legally carrying a firearm. Maybe not at all. Maybe very different.

If someone had been openly carrying, would Loughner have been deterred? Or would he have targeted the openly armed citizen first? We will never know, of course.

We should not assume that more gun restrictions would have kept Rep. Giffords any safer.

Left Wing Media Exploit Tragedy, No Facts Needed

While the investigation of the crazed shooter in Tuscon who shot 18 people, killing six, including a federal judge, and critically wounding US Representative Gabrielle Giffords, the left wing media are predictably accusing their political opponents of being the root cause of the shooting.

The facts, as they trickle out, paint a different picture.

First, no one has determined the actual motivation for the shooting. By all accounts the young man is mentally deranged.  Neither the right nor the left has a monopoly on crazy.

Is the guy a leftist because he had Mein Kampf and A Communist Manifesto in his library and because he has an apparently satanist shrine at his home? It is a right-winger, because he ranted about going back to the gold and silver standard for money?

The left wing media (which is almost all mainstream media) is disrespecting the dead and the injured by its assumptions that political speech opposing left wing lunacy is somehow to blame.  The left calls it vitriol.

For the true vitriol, to the left face, harch! The vitriol -- which the left-wing media ignores -- is all over the place. Michell Malkin chronicles the left wing vitriol thoroughly here. Tim Blair at the Daily Telegraph also demonstrates the media hypocrisy.

In the meantime, the gun controllers can be expected to use this tragic event as a springboard to take away your Second Amendment Rights through stealth legislation.

More Guns Helps DC Crime Rate

From John R. Lott concerning Washington DC since the Heller decision:

Washington’s murder rate has plummeted -- falling by 25 percent in 2009 alone. This compares with a national drop of only 7 percent last year. And D.C.'s drop has continued this year.

Comparing Washington’s crime rates from January 1 to June 17 of this year to the same period in 2008, shows a 34 percent drop in murder. This drop puts D.C.'s murder rate back to where it was before the 1977 handgun ban. Indeed, the murder rate is as low as was before 1967.

Other gun crimes have also fallen in Washington. While robberies without guns fell by 7 percent, robberies with gun fell by over 14 percent. Assaults with weapons other than guns fell by 7, but assaults using guns fell by over 20 percent.

Dear Mr. Helmke,

Inspired by the tea party movement, I am seriously considering running for office. However, since I have no prior legislative experience, I'm writing to find out how I can apply for the coveted "F" rating from the Brady Campaign. I think the "F" rating is important to my expected campaign.

Could you please send me an application so I can formally request the coveted "F" rating. In support of my application, my campaign philosophy will recognize that the best way to prevent gun violence is to arm law-abiding citizens. Criminals should fear the law abiding citizen, not the other way around. I will promise to introduce or support legislation along the following lines:

• A well regulated militia being essential to the security of a free state, I will support or propose a tax credit for the purchase of assault weapons and for the purchase of training in the use of small arms.

• Measures that would make ammunition and range fees tax-deductible, it being in the public interest that all citizens be well-trained in the use of firearms, including safety and proficiency.

• A federal prohibition on microstamping along with a specific federal preemption to prevent the states from adopting this foolish, expensive monopoly technology.

• 50 state reciprocity for concealed carry permit holders.

• Elimination of bans on possession of weapons in federal buildings and on airplanes, in a sincere belief that terrorists will be more intimidated by the prospect of ordinary citizens stopping them than they are be by being assured that their fellow passengers are defenseless.

• Modifications to the federal weapons disability laws to permit gun possession by non-violent felons and rights to apply for and obtain relief from the disability upon appropriate showings of a history of non-violence.

• Mandatory gun safety and shooting classes in public schools, including handgun and rifle training, coupled with elective courses on the public benefits of harvesting excess deer.

• Abolition of the ATF.

Surely these simple measures, all of which are just, reasonable, and appropriate for enactment are sufficient for me to earn your coveted "F" rating.

When you issue your "F" rating, do I get a certificate? Could we do a joint press release?

More proof that zero tolerance policies mean zero intelligence.

In Staten Island, New York, a 9 year old son of a retired police officer brought a LEGO toy to school. You guessed it: A LEGO police officer with a two inch gun.

Zero intelligence kicks in to teach a boy who formerly loved school that public school really is an evil place. His parents were called in, he was given a scolding, and we hear, nearly suspended.

Since the story comes to us from MSNBC, We assume that based on her previous history, Contessa Brewer thinks racism caused the boy to bring the toy to school.

Prevent Homocide: "Buy a Gun"

This is the advice from a Buffalo, gun-unfriendly New York, gang member, as reported in the Buffalo News. I am not one to take advice from gang members. This time he is right, as confirmed by virtually all studies.

It seems to me that the Buffalo News article is really about how most gun violence is somehow related to illicit drugs, either by rival gangs or druggies trying to get money for the next fix. One thing is for certain: we have not solved the problems cause by illegal drugs by prohibiting the manufacture, importation or sale of them. We have increased the street price and the profit by limiting the supply. The result of that strategy is, of course, more crime. Druggies need to steal more money to get the next fix. Drug gangs make more money by supplying the illegal substances.

The whole war on drugs thing needs a new look and new approach. Our legislators in Congress and in the several states lack any understanding of the laws of economics.

Get this straight. Drugs are bad. But the current prohibition strategy is seriously flawed.

Military Bases as Gun Free Zones

When it comes to gun rights, is the anything dumber, more counterintuitive, than making military bases gun free zones?

As the writer of the linked letter to Stars and Stripes calls it, military bases are "victim disarmament zones."

Why are guns prohibited on military bases? Don't our guys in uniform get adequate training in gun use and safety?

Political correctness run amok.

Heller Applied in State v. Skoien

In United States v. Steven Skoien, No. 08-3770 (Nov. 18, 2009 7th Cir. 2009) the US Court of Appeals for the 7th Circuit vacated the conviction of Steven Skoien for unlawfully possessing a firearm while under a disability in violation of the federal statute 18 U.S.C. § 922(g)(9).

Mr. Skoien had previously been convicted of misdemeanor domestic violence. He was caught hunting with his father's 12 gauge shotgun, after it was discovered that he had obtained a hunting license.

He appealed his conviction in the district court. In reversing and remanding the case, the Court of Appeals gave the government the opportunity for a hearing on a single issue:

The government has the burden of establishing a reasonable fit between its important interest in reducing domestic gun violence and the means chosen to advance that interest-- § 922(g)(9)’s total disarmament of domestic-violence misdemeanants.

If the government meets that burden, the conviction will be automatically reinstated.

NRA, are you listening? The government must prove that there is a reasonable basis for banning all gun possession for life when someone is convicted of misdemeanor domestic violence. Of any severity. This could be an important case for gun rights.
